1. Agreement to Terms

By accessing and using the website jaybenjamin.com (the “Site”), including purchasing products or booking services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site.

2. Intellectual Property Rights

Original Content: All original content on this Site, including music, lyrics, blog posts, photographs, and branding created by Jay Benjamin, is the property of Jay Benjamin and is protected by copyright law. This content may not be used, reproduced, or distributed for any commercial purpose without prior written consent.
Cover Song Content: Lyrics and chords for songs written by other artists (“Cover Songs”) are provided for personal, educational, and non-commercial use only (e.g., for learning to play and sing along). The original copyright for these works belongs to their respective owners.

3. User-Generated Content

You may be able to post comments or other content on the Site. You are solely responsible for the content you post. We reserve the right, at our sole discretion, to remove any content we deem to be unlawful, offensive, spammy, or otherwise inappropriate.

4. Accounts

When you create an account on our Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

5. Purchases and Payments

a) Physical Products (Merch):

We offer a 30-day return policy for physical products. To be eligible for a return, your item must be in the same condition that you received it (unworn or unused) and in its original packaging.
The customer is responsible for paying for their own shipping costs for returning an item.

b) Digital Products (Music Downloads):

(Please Review) Due to the nature of digital products, all sales of digital downloads are final. No refunds will be issued once a product has been downloaded.

6. Booked Services (Lessons & Gigs)

a) Lessons & Coaching:

(Please Review) Cancellations or rescheduling requests must be made at least 24 hours prior to the scheduled lesson time to be eligible for a full refund or to apply the credit to a future lesson.
Cancellations made within 24 hours of the lesson time and “no-shows” will forfeit the full lesson fee.

b) Instantly Booked Live Performances:

(Please Review) These bookings are considered a firm agreement to hold the selected date. A 50% refund of the total fee will be provided for cancellations made more than 30 days prior to the event date.
No refund will be provided for cancellations made within 30 days of the event date.

7. Governing Law

Any claim relating to the Site shall be governed by the laws of the State of North Carolina without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of these Terms and Conditions shall be instituted in the federal or state courts located in Guilford County, North Carolina.
